The first question we would ask you if you call our office is what caused you to trip and fall?  Was it something that was “open and obvious” according to current Michigan law?  Was it a hidden defect or something that you could not easily see on casual inspection?  How was the lighting?  Was there any way to avoid this defect?  There is a whole list of facts that we would need to know before we could really give you a legal opinion as to whether or not you have a case against the business or property owner.

When you call our office we first gather all the information about the fall.  Then we will be able to give you our opinion as to whether you have a legal basis to make a claim.  If we do feel that you have a claim, we will set up a meeting.  Often times we come out to your home.  We then gather much more detailed information we need to open your file.  After that we usually send a letter to the property owner advising that we are your legal representatives.  Many times the property owner then turns it over to their insurance company who will contact us.  They may present additional facts that we were not aware of and we would advise you of that.

How long does it take to settle your case?  That depends on many factors such as when your medical treatment is complete, and whether your case needs to go into the court system.  We can discuss these details with you when you contact our office.
