Slip and Fall at Apartment Parking Lot Settles for $80,000 in Southeast Michigan

One of our former clients had a situation where he fell on the sidewalk of his apartment building.  The fact scenario goes as follows:

Mr. Smith (not his real name) had lived at this particular apartment building for several years.  He noticed that in one location the sidewalk that led out to the parking lot was sloped in a way that whenever there was snow melt during the winter the runoff would cover an entire area of the sidewalk.  Then, when the temperature would go below freezing, that portion or slab of the sidewalk would turn to slick ice that was difficult to see becoming a very dangerous situation.

On this particular morning Mr. Smith was going to work and took the sidewalk to get to his car.  As he was walking he slipped and fell on this slick ice and seriously fractured his ankle.  He went to the ER immediately and went through several months of treatment also missing a good amount of time from work and losing wages.

We argued that the apartment management was, or should have been, aware of this condition.  We were able to obtain photos showing that run off occurred from the grass and down this portion of the slab where it would freeze upon colder weather.  That proved that the condition that created ice to form in this area was something that they should have been aware of and remedy, which they failed to do.

Ultimately this case settled for $80,000.  Though we cannot guarantee any outcome, we and our client were very pleased with this result.
