Michigan statute, MCL 691.1401, specifically addresses these types of defects, and talks about when an individual can or cannot make a claim against a governmental entity. These types of falls can result in very serious injuries ranging from broken bones, neck and back problems to traumatic brain injuries.
These sidewalk cases are particularly complex. Under normal circumstances, a governmental entity has immunity, and you cannot make a claim against them. However, under some limited circumstances, you can make a claim against a city or governmental entity. MCL 691.1402(a) states that a defect that is less than two inches on a sidewalk, trail way, crosswalk or other installation outside of the improved portion of a highway designed for vehicle travel raises a rebuttal inference that the municipal corporation maintained the area in reasonable repair for the highway exception immunity. In other words, the condition is assumed to be safe if it is less than two inches, but a claim is not necessarily barred if it is less than two inches. However, recent case law may significantly impact this statute, please check with our firm to get more information.
