Automobile Accident
and Denial of No-Fault Insurance Benefits
Case study — A 37-year old father of three young children was severely injured in an automobile accident when a drunk driver crossed the center line and hit him. Our client suffered two fractured legs and could not walk. Through his own No-Fault Insurance we made certain that he received payment of all medical bills and wages. We also secured his home medical equipment. This included a hospital bed, so he did not have to be restricted to his bedroom upstairs, and home nursing so his condition could be monitored while he was surrounded by his family. We also secured a financial settlement for his injuries, and his extended pain and suffering.
Uninsured Motorist
Case study — A paramedic's ambulance was struck by a car that ran a red light. He suffered a devastating shoulder injury which permanently disabled him, preventing him from returning to work as an Emergency Medical Technician. While on the scene, police officers told him that the other driver was a high school student, and the vehicle was uninsured. Our client was led to believe that he had no source of financial recovery. Fortunately, he called our offices. Our legal investigation soon revealed that our client's employer had a large Uninsured Motorist policy. After legal interaction, we were able to obtain a large settlement for our client.
Motorcycle Accident
Case study — In the darkness of a moonless night, our motorcyclist-client suddenly came upon an abandoned automobile. He tried to swerve out of the way, but was unsuccessful. He sustained terrible leg trauma that required the insertion of a metal rod. MMK attorneys argued his case up to the Michigan Court of Appeals and won. In a published opinion, judges agreed that our client was entitled to insurance coverage . Our client received a significant settlement for those damages in addition to his no-fault benefits for medical bills, wage loss, and home assistance.
Slip/Trip and Fall
Case study — A hidden step at a private home caused one female party-goer to fall and break her ankle. She was permanently disabled as a result. Our attorney took this case to the Michigan Court of Appeals, and an earlier decision was reversed. Our client was awarded a very large cash settlement.
Dog Bites and other Animal Incidents
Case study — A seven-year-old girl was attacked by her neighbor's German Shepherd dog. Her lower lip was nearly severed and required a number of reconstructive surgeries. We obtained medical expenses, coverage of all future surgeries and compensation for pain, suffering, and her disfigurement.
Medical Malpractice
Case study — A young woman returned to her medical center time and time again with recurrent infections. She was tired, run down, and her head hurt. The doctor treated each infection in turn, but never made the essential diagnosis: HIV/AIDS. Because she did not fit the "AIDS profile", she was never even tested. While medical advances can extend the lives of HIV positive patients, this young woman never had the chance for treatment because no one knew she had the virus. Her parents approached us after her death, and we understood that the hospital made a grave mistake, and they deserved compensation for the untimely loss of their child. We sued the hospital and won a large financial settlement for her family, including parents and grandparents. And, her parents gained some satisfaction knowing that those doctors won't be so hasty in dismissing the possibility of HIV in the future.
Wrongful Death
Case study — A 51-year old grandmother died just hours after she was involved in a car crash, but doctors said the cause of death was "undetermined." After an in-depth investigation, our attorneys concluded that her death was related to the accident, and were able to build a strong case for financial recovery. We secured a very substantial settlement for her family, including her children, grandchildren and siblings.
Railroad Accident
Case study — A 12-year -old boy living in Southwest Detroit was anxious to get home before curfew. He hopped one of the many slow-moving freight trains that rumbled through his neighborhood — and fell off. The train rolled over the boy, severing his legs and right arm. Miraculously, he survived. When his parents approached our firm, they didn't think they had any legal recourse. We filed a lawsuit against the railroad company claiming, in part, that they should have posted guards at the crossing to prevent children from alighting. A very large financial settlement was obtained for the youth to compensate for his severed limbs, and to help him manage a disabled lifestyle.
Defective Product
Case study — A clogged drain led one retired gentleman to the hardware store, where he purchased some drain cleaner. He had used the material before and took precautions, but nothing prepared him for the explosion of acid when he poured the solution into the drain. As a result he lost sight in one eye and suffered severe facial scarring. Our attorneys took this case to trial, and secured a large financial settlement for this client from the manufacturer of the dangerous product.
Workers Compensation
We understand that workers can be in a tight spot when an injury occurs on the job. Often when an accident happens, workers hesitate to report it for fear of being labeled a complainer. So they wait, hoping the pain will pass. But when the pain doesn't fade, and the employee reports the accident later on, he is told, "you waited too long. It didn't happen here."
Case study — After a bad lifting accident at work, a 40-year-old factory worker was in great pain. When he reported the accident, his employer implied he was not entitled to benefits. Then the factory worker came to see the attorneys at MMK. We filed an immediate action and got his insurance company involved so that in a short time he received complete medical treatment and full benefits.
Social Security
Case study — "You're not sick enough" a 53-year-old woman suffering from chronic arthritis and diabetes was told, and twice denied Social Security and Disability benefits. But she was very ill. By presenting her case to the Social Security Administration, our lawyers obtained these benefits for her, in addition to two-and-a-half years past due benefits.
Lead Paint Poisoning
Case study — Shoddy maintenance in a rented urban home enabled a child to ingest lead-based paint. He was later diagnosed with severe learning disabilities directly linked to earlier poisoning. We obtained a large settlement for damages for this child.
